PLEASE CAREFULLY READ THE FOLLOWING PRIVACY POLICY GOVERNING YOUR USE OF THE NICK LARRY LAW LLC WEBSITE (“the Site”). The website you are visiting is owned and managed by Nick Larry Law LLC (“NLL”). Your use of this Site is subject to the Privacy Policy set forth herein, and the Site’s Terms of Service. By using the Site, you give your assent to the terms of this Privacy Policy and the practices set forth herein. If you do not agree to this Privacy Policy, you may not use the Site. Nick Larry Law LLC has the right, in its sole discretion, to modify, add or remove any terms or conditions of this agreement without giving individual notice to you, by posting the changes on the Site. Your continuing use of the Site signifies your acceptance of any such changes.

Information Collected Automatically

As with most websites, if you visit the Site, your web browser automatically sends NLL (and NLL may retain) information such as the:

  • Internet domain through which you access the Internet (e.g., yourServiceProvider.com if you use a commercial Internet service provider, or yourSchool.edu if you use an Internet account from your school);

  • Internet Protocol address of the computer you are using;

  • Type of browser software and operating system you are using;

  • Date and time you access the Site; and

  • The Internet address of the site from which you linked directly to the Site.

  • NLL uses this information as aggregate data to help maintain this Site, e.g., to determine the number of visitors to different sections of the Site, to ensure the site is working properly, and to help make the Site more accessible and useful.

  • NLL does not obtain personally identifying information (such as name, email address, phone number, or street address) when you visit the Site, unless you choose to provide such information.

Other Information Collected

If you choose to identify yourself or otherwise provide NLL with personal information) when you use the Site’s online forms:

NLL will collect (and may retain) any personally identifying information, such as your name, street address, email address, and phone number, and any other information you provide. NLL uses this information to try to fulfill your requests and to provide you with additional information at a later time. NLL will not disclose such information to third parties, except as specified in this Privacy Policy and the Terms.

If you request information, services, or assistance, NLL may disclose your personal information to those third parties that (in NLL’s judgment) are appropriate in order to fulfill your request. 

If your communication relates to a law enforcement matter, we may disclose the information to law enforcement agencies as NLL deems appropriate. Consistent with its ethical obligations, if NLL, in its best judgment, believes disclosure of information regarding your use of the Site or communications with NLL is necessary to prevent reasonably certain death or substantial bodily harm, NLL shall disclose such information to the appropriate law enforcement agency. 

Information Use and Retention

NLL discloses personally identifiable information about individual users in accordance with this Privacy Policy and the Terms, or when it has a good-faith belief that such action is necessary to comply with applicable laws, valid legal process, a court order, a current judicial proceeding, or to protect its rights or property. We also disclose personally identifiable individual information and the other information you provide to lawyers or law firms with whom NLL affiliates and who are interested in determining whether your submission could form the basis of a lawsuit or entitle you to relief under a pending lawsuit. Such lawyers or law firms agree to keep your information confidential and agree not to share it with any third party without your express permission. NLL may also provide aggregate statistical information (such as the city or state you live in) to third parties to describe our services to prospective partners, and other third parties, and for other lawful purposes. 

NLL also works with vendors to process data, operate the website, and perform functions in furtherance of any representation. For example, NLL may use outside vendors to send email updates, or to collect information relevant to a client’s potential claim. 

Please keep in mind that whenever you voluntarily disclose personal information online – for example on message boards, through email, or in chat areas – that information can be collected and used by others. 

NLL may keep information collected from you for as long as it determines is reasonably necessary.  

Security

Please note that electronic communication, particularly email, is not necessarily secure against interception. Please do not send sensitive data (e.g., Social Security, bank account, or credit card numbers) by email or web form. 

Cookies

NLL uses cookies to ensure and optimize Site functionality, to perform analytics functions, and to optimize the Site for return visitors. This Site runs on Squarespace, and there is more information about the cookies used by Squarespace here. Additionally, third-party widgets may install cookies depending on their configuration. You are not required to accept any cookies to use this Site.

Google Analytics

NLL may use a tool called “Google Analytics” to collect information about use of this Site. Google Analytics collects information such as how often users visit this Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. We use the information we get from Google Analytics only to improve this Site. Google Analytics collects only the IP address assigned to you on the date you visit this Site, rather than your name or other identifying information. We do not use Google Analytics to collect personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this Site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this Site by disabling cookies on your browser. 

Other Privacy Matters

Information From Children: NLL does not direct the Site to children under thirteen (13) years of age. Individuals under eighteen (18) should not use the Site.

Monitoring, Enforcement, and Legal Requests: NLL is not obligated to monitor the Site or its use, or to retain the content of any user session. However, NLL reserves the right at all times to monitor, review, retain, and/or disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to cooperate with law enforcement and other authorities in investigating a claim of illegal activity. NLL may use IP addresses to identify a user when we feel it is necessary to protect our service, website, clients, potential clients, or others.

Other Websites: Except as otherwise expressly discussed in this Privacy Policy, this policy only addresses NLL’s use and disclosure of information it collects from you. To the extent that you disclose personal information to other websites, you are subject to the privacy customs and policies of those other sites. We encourage you to ask questions before you disclose any personal information.

Transmission Errors or Unauthorized Acts: No data transmission over the Internet can be guaranteed to be 100 percent secure. While NLL strives to protect your personal information, NLL cannot ensure or warrant the security of any information you transmit to us or any information provided online, and you do so at your own risk. NLL will not be liable for disclosures of your personal information due to errors in transmission or unauthorized acts of third parties. Once NLL receives your transmission, NLL will endeavor to ensure its security on NLL’s systems by making reasonable efforts to protect the information. 

Biometric Data Privacy Policy

In the course of pursuing claims on behalf of an individual, a group of individuals, or a class, NLL may come into possession of the individual, inviduals’, or class members’ biometric identifiers or biometric information. This policy governs NLL’s collection, use, storage, and disclosure of any biometric identifiers or biometric information obtained or possessed by NLL.

Biometric Data Defined: As used in this policy, “biometric data” means biometric identifiers or biometric information as defined in the Biometric Information Privacy Act, 740 ILCS 14/1–99 (“BIPA”). “Biometric identifier” means a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry. “Biometric information” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual. BIPA excludes certain types of informatio from the meanings of both “biometric identifier” and “biometric information.” 740 ILCS 14/10.

Retention Schedule and Destruction Guidelines: NLL shall retain biometric data only until the earlier of (a) the initial purpose for which NLL obtained the biometric data (the litigation of claims on behalf of the individual or class) has expired, or (b) within three years of the cessation of NLL’s representation of the individual or class. Upon the expiration of that time period, NLL will delete any copies of the biometric data in its possession.
